Court Docs Suggest Sisters, 3 and 4, May Have Been Strangled to Death by Their Father: Reports

New court documents suggest that two Colorado children who were allegedly murdered by their father may have been strangled, according to multiple news outlets.

Denver NBC affiliate 9News reports the two motions were filed on Friday morning in Weld County court by defense attorneys representing Chris Watts, 33, who has been accused of murdering his 34-year-old wife Shanann — who was 15-weeks-pregnant at the time — as well as their two young daughters, Celeste, 3, and Bella, 4.

In the motions, attorneys asked that DNA samples be taken from both the two children as well as from the mother during their autopsies, which were scheduled to begin on Friday, reported CBS4.

DNA expert Richard Eikelenboom claimed in the filings that DNA samples “would remain on the necks of the decedent children,” according to ABC affiliate Denver 7. The motion also asked that DNA samples be taken from the hands and nails of the girls’ mother.

Attorney James Merson wrote in the docs that while the bodies of the two children had “been in an oil well filled with crude oil for several days,” Eikelenboom believed “DNA would still be present,” according to 9News.

The DNA expert was also quoted in the motion saying he believed that samples can still be obtained “after strangulation,” according to Denver 7.

However, the outlet went on to report that in 2016 the Denver District Attorney’s Office released a statement discrediting Eikelenboom after “a Denver prosecutor got Eikelenboom to admit that he had no direct DNA extraction or analysis experience.” Eikelenboom has disputed the claim.

Shanann and her two daughters were reported missing by a friend on Monday afternoon, about 12 hours after returning from a business trip. Before he was taken into custody, Chris had given multiple interviews pleading for their safe return.

During one such appearance, he said that shortly she disappeared, he and Shanann had an “emotional conversation.”

Without providing any further information on the subject, he added, “I’ll leave it at that.”

Following her husband’s arrest, Shanann’s body was found Thursday on the property of Anadarko Petroleum Corporation, an oil and gas company where Chris had worked. Remains believed to be daughters Bella and Celeste were located later Thursday near Shanann’s body, officials said.

Chris was arrested Wednesday on three counts of first-degree murder and three counts of tampering with a body.

While investigators have not publicly confirmed a motive, a family friend previously told PEOPLE that there was marital discord between Chris and Shanann and public records show they had faced financial issues in the past, including a bankruptcy in 2015.

Chris is next scheduled to appear in court on Tuesday, where he will face formal charges.

For nearly two years, Mandi and Tyler Palmer, of Perrysburg, Ohio, dreamed of the day they could officially call little Hunter their son.

“Once we got licensed as foster-to-adopt parents, that week, we got the phone call for Hunter. He was 8 days old,” Mandi, 33, tells PEOPLE. “We went and picked him up at Children’s Services. We brought him home and we went through the roller coaster ride of foster care for that entire year.”

After facing a few setbacks, and the uncertainty of Hunter being taken in by another family, Mandi and Tyler, 31, learned last December that they’d finally be able to adopt Hunter. So, on Dec. 18, the family-to-be dressed their best and headed to a local courthouse, where they signed the official paperwork to adopt the 17 month old.

“It was very emotional, in a good way. We had all of our family and friends there,” Mandi says. “At the end of the court process, the judge announced new legal name. And they read the adoption decree and that’s when Hunter looked at my husband and he said, ‘Dad!’ ”

She adds: “He just started clapping and everybody just started crying. It was so emotional. It’s definitely rewarding. It’s nice to look in his eyes now and not have to worry that he’s ever gonna have to leave us again.”

Mandi and Tyler, who wed in 2014, had always dreamed of being parents. Due to complications from Mandi’s Crohn’s disease diagnosis, Mandi was not able to conceive.

“That’s when we started looking into other options and we were talking about adoption and we kept hearing our county’s commercial for the need of foster parents in our area,” Mandi tells PEOPLE.

“We were scared. We kind of danced around the idea for a little bit. Then we prayed on it, and we just felt like God pushed us to do it,” she adds.

She and Tyler have viewed Hunter as their son since the moment they met the sweet infant, and Mandi tells PEOPLE that she’s happy their family is finally complete.

“On adoption day, it’s almost like a ton of bricks just came off our chest. We now know that he’s never leaving us,” Mandi says. “He’ll always be safe and loved with us. So that in itself is rewarding.”

She adds: “Life just happens. We’ve loved him since we’ve gotten him. We’ve cared for him as if he was gonna be with us forever, because every child deserves that.”

‘The People’s Court’ Judge Joseph Wapner Dies At 97

Joseph Wapner, the feisty retired judge who for more than a decade presided over courtroom TV show “The People’s Court,” has died. He was 97.

Wapner was hospitalized last week for breathing problems and was transferred to his home in West Los Angeles under hospice care. He died Sunday morning, TMZ first reported.

Wapner, who was the first judge to serve on the bench of “The People’s Court,” helped popularize the court TV genre. He made his TV debut on the show in 1981 and presided until the series was canceled in 1993. (It was rebooted four years later.)

The show was the first to use the format of binding arbitration; parties came on the show to resolve the kinds of disputes typically handled in small claims courts.

Wapner was technically an arbitrator in his capacity on the show, but he was a real judge: He spent 20 years as an L.A. County Superior Court judge before becoming a TV star. 

“The People’s Court” and Wapner became pop culture touchstones during the 1980s and ‘90s: They were parodied on “Saturday Night Live,” and Dustin Hoffman’s character in the 1988 hit film “Rainman” is shown counting down the minutes until show started. 

Joseph Albert Wapner was born on Nov. 15, 1919, in Los Angeles, the son of a lawyer and a homemaker.

He called his Depression-era upbringing “difficult,” but said in 2005 that he had learned “you have to work hard for everything you get.”

“You have to want to do things, and you have to work at it,” he said. 

Wapner attended Hollywood High School with dreams of becoming an actor ― and he often recalled his unsuccessful courting of his classmate and future star, Lana Turner ― but his father had plans for him to follow him into the legal field. 

“Before I even passed the bar, he had cards printed up that read ‘Wapner and Wapner,’” the judge said. “He was more interested than I was.”

Wapner graduated from the University of Southern California, but joined the Army before he started law school. He was wounded during combat in the Philippines and was ultimately awarded a Bronze Star and a Purple Heart.

After his service in the armed forces, Wapner returned to USC for law school and joined his father in private practice before breaking off on his own. 

In a 2005 interview with the Archive of American Television, Wapner said listening was the most crucial skill for a judge to have.

“Listen to both sides with an open mind. Know the law, and be fair to both sides,” Wapner said. He said he hoped those characteristics would also be his legacy.  

“I’d like to be remembered as a judge who acted as a judge should,” he said. “I want to be remembered in a kindly way. In a positive way.”

Wapner is survived by his wife of 70 years, Mickey Wapner, and sons Fred ― also an LA Superior Court judge ― and David. Wapner’s only daughter, Sarah, died in 2015.

Appelate Court Tosses Out LVMH’s Claim Against Spoof Brand My Other Bag

GOOD HUMOR: LVMH Moët Hennessy Louis Vuitton has lost its legal fight against spoof tote bag company My Other Bag. On Dec. 22, the United States Court of Appeals for the Second Circuit tossed out the luxury conglomerate’s appeal from a judgment of the United States District Court for New York State’s southern district.
In January 2016, Judge Jesse M. Furman had struck down the luxury conglomerate’s formal allegations of trademark dilution, violation of fair use, dilution by blurring, trademark infringement and copyright infringement. The firm first filed these claims against My Other Bag in 2014.
In its summary order, which affirmed the judgment of the district court, the Second Circuit said that “obvious differences in My Other Bag’s mimicking of Louis Vuitton’s mark, the lack of market proximity between the products at issue, and minimal, unconvincing evidence of consumer confusion compel a judgment in favor of My Other Bag on Louis Vuitton’s trademark infringement claim.”

Duchess of Cambridge Opens Magic Garden at Hampton Court

10 Divorce Court Horror Stories, Straight From Attorneys

There’s nothing like divorce to bring out the worst in people. Just ask divorce lawyers.

Below, attorneys who specialize in family law share the craziest antics they’ve had the pleasure of witnessing over the years. (Out of respect for their clients, they’ve requested to remain anonymous.) 

1. “One of my clients had a chemical peel before her deposition so she could look good in front of her husband. Instead, her skin turned bright red and began falling off of her face during the meeting!”

2. “After a lengthy and harshly contested divorce case, the wife looked out her window on the day after the trial ended and saw a moving van at the house next door. It was her ex moving in. He had purchased their neighbor’s house secretly during the trial.” 

3. “The only thing my client wanted from the house were her son’s bar mitzvah pictures. We agreed that her husband would keep the album and she would get all the prints. When the prints were delivered to her, she realized that her image had been cut out of all the photos. When she confronted her ex about this he claimed, ‘Oops, your sister must have done it to make me look bad.'”

4. “When I first started practicing, I had a contested custody case. To me, my client looked like Laura Ingalls Wilder and seemed the part. Imagine my dismay when, on cross-examination, the husband’s attorney starts shaking a videotape in her direction, shouting, ‘and isn’t it true that this video tape, made for commercial distribution, depicts you having sexual intercourse with a chainsaw?’ My jaw dropped, my face turned ashen and the room started to spin. The judge, knowing I was just a Baby Lawyer and sensing I didn’t deserve to be pummeled publicly over this, dropped his gavel onto the bench with a bang, calling, ‘Recess!  I’ll see counsel in chambers!’ We settled that case.”

5. “I find it funny when a client is ordered to provide a hair follicle drug test, then shows up for the test having shaved their head, not realizing hair follicle tests can be achieved with leg hair, hair from the armpit or pubic hair; it’s even better when the client realizes that any hair can be used, so waxes their whole body and calls it a ‘lifestyle choice.'”

6. “One night my client was leaning on the kitchen counter, shooting the breeze with his wife and she said to him, ‘Do you want chicken or fish tonight for dinner? I need to know what to take out of the freezer. Oh, and by the way, I’m having an affair with the next door neighbor so I want a divorce.’ Her nonchalance really threw him into a tailspin; if she could break that kind of news to him as easily as ‘chicken or fish,’ what else did she have up her sleeve? He became convinced she was trying to kill him to expedite her love plans with the neighbor and that she’d accomplish this by poisoning his food. He installed a deadbolt on his bedroom, bought himself a mini-fridge and a hotplate and he didn’t leave his room until the mandatory waiting period to finalize the divorce expired.”

7. “This was a hotly contested divorce. The husband (who had been having an affair) agreed to buy out the wife’s interest in their home for more money than the wife would ever have received if she had kept the home and sold it herself. When the couple appeared in court to finalize the divorce, the wife, who had previously agreed to everything, refused to sign the papers unless the husband gave her every last landscaping rock surrounding the house. She didn’t want to be paid for the value of the rocks. She wanted the husband to agree to rip out those exact rocks from the front yard and give them back to her because she claimed they were a gift from her father. At the time, she lived in an apartment.”

8. “My client hated his wife so much that mere idea of her having his toolbox was abhorrent to him. He asked for temporary use and possession in a $ 3,000 hearing (actual cost of attorney’s fees) for tools that were worth $ 500. By the time we drafted the motion for his use and possession of tools, I advised him that I could have bought him a top-of-the-line new set at my hourly rate — and without looking so petty in front of the judge. Opposing counsel was in the same boat, arguing over the same, silly tools. The judge called us into her office mid-hearing, and literally laughed out loud for a solid minute before she told us to get out of her courtroom and make our clients behave.”

9. “During a very heated divorce, it came as somewhat of a surprise when the wife, who had been fighting for the contents of the house, quickly agreed to give up the living room furniture set to her husband, who had moved to a new place. When the movers delivered the furniture, the husband start wheezing and sneezing within minutes. He was allergic to cats, something his former wife knew. Turns out that right after he moved out, she bought three longhaired Persian kitties. Their favorite place to sleep and shed? You guessed it…all over the velvety, soft living room furniture.”

10. “I represented a woman in a divorce. When I told her that she would receive over $ 300,000 per month in support she said to me, ‘How am I going to live on that?I guess the husband couldn’t live with that, either; he died of a heart attack before the divorce was finalized.”

WATCH: The Best and Worst Parts of the Supreme Court Marriage Ruling

It’s been less than 50 years since the Stonewall riots and the foundation of the modern LGBT liberation movement. And here we are, with marriage equality newly-recognized from coast to coast. It’s amazing.

But June isn’t just the anniversary of Stonewall. It’s the anniversary of the ruling that overturned the federal marriage ban, and the ruling that ended the criminalization of homosexuality. And it’s close to the anniversary the ruling that for the first time extended equal protection to LGBTs.

All of those cases were written by Justice Anthony Kennedy. And now, he’s given us a decision that establishes the freedom to marry as a fundamental right. Five justices agreed with Kennedy, and four disagreed for various reasons that really do not hold up. Let’s take a look at how Kennedy’s decision works, and then talk about why the dissent is so wrong.

Kennedy’s ruling is based on four ideas: freedom includes the freedom to choose who you marry, marriage is vital for relationships, marriage protects kids and families and marriage is a cornerstone of American society.

Central to Kennedy’s ruling is this:

The nature of injustice is that we may not always see it in our own times. The generations that wrote and ratified the Bill of Rights and the Fourteenth Amendment did not presume to know the extent of freedom in all of its dimensions, and so they entrusted to future generations a charter protecting the right of all persons to enjoy liberty as we learn its meaning.

In other words, the Constitution’s set up so that as we become a more enlightened society, we can improve our own laws to reflect that enlightenment.

Ultimately, Kennedy wrote,

Marriage allows two people to find a life that could not be found alone, for a marriage becomes greater than just the two persons. Rising from the most basic human needs, marriage is essential to our most profound hopes and aspirations. The Constitution grants … that right.

Five justices agreed, four didn’t.

Essentially, the dissenters believe that marriage isn’t a fundamental right, or that it is for everyone except same-sex couples, which is very convenient.

Roberts calls marriage bans a “decision to maintain the meaning of marriage that has persisted in every culture throughout human history,” and an “unvarying social institution enduring over all of recorded history.”

Well, that’s just wrong. As we know, marriage has varied a lot. Virtually nothing about marriage has persisted throughout every culture. It is in a state of constant change and, though gradual, improvement.

Thomas has what may be the strangest dissent. He says that human dignity is innate and can’t be granted or taken away by the government. And here’s where he goes with that:

Human dignity cannot be taken away by the government. Slaves did not lose their dignity … because the government allowed them to be enslaved. Those held in internment camps did not lose their dignity because the government confined them. And those denied governmental benefits certainly do not lose their dignity…

Did Thomas just mean to defend slavery? Probably not, but he also probably didn’t mean to suggest that banning marriage is similar to slavery and internment.

What he means, is that if you only acknowledge the personal, internal aspect of dignity, then yeah, no one can take that away. But dignity has external qualities as well. Slaves were definitely deprived of something, for example their freedom and very recognition of their humanity. And it seems like some amount of dignity would go along with that.

Roberts, meanwhile, admits that marriage changes, writing “the ‘history of marriage is one of both continuity and change,’ but the core meaning of marriage has endured.”

And there’s the fundamental disagreement. The core meaning of marriage. Is it, as Kennedy says, an embodiment of “the highest ideals of love, fidelity, devotion, sacrifice, and family”?

Or, is it as Alito says, “the one thing that only an opposite-sex couple can do: procreate.”

I don’t know. Between those two — love fidelity devotion sacrifice and family, or procreate — which sounds more like a wedding vow to you?

Gay Men’s Chorus Of Washington Offers Rousing Performance At Supreme Court

The Gay Men’s Chorus of Washington, D.C. celebrated the Supreme Court’s historic ruling on same-sex marriage this morning with an emotional performance. 

Dressed in matching blue T-shirts, the men crooned a rousing version of “The Star-Spangled Banner” on the steps of the Supreme Court itself.

On Friday afternoon, celebrations were going on around the country, including in New York and San Francisco, often cited as the respective birthplaces of the lesbian, gay, bisexual and transgender (LGBT) rights movement.

Bobby Flay and Stephanie March’s divorce is not what you’d call amicable.

The couple split in early April after 10 years of marriage and March is challenging the prenup under which Flay is required to pay the actress $ 5,000 a month.

In Touch reports that March is challenging the prenup on the grounds that Flay allegedly cheated on her with three women, including actress January Jones.

A source familiar with the case told the magazine that the former “Law & Order: SVU” actress is claiming in court papers that the 50-year-old celebrity chef “committed adultery” with Jones several times in the in early 2010. The magazine also reports that March has accused Flay of cheating with a food stylist and his assistant.

Page Six previously reported that it’s believed the couple’s prenup had no infidelity clause, and if true, March’s claims likely would not help her cause. However, TMZ reported that the actress also filed documents claiming that it’s her “amazing palate” that is responsible for his success.

Reps for Flay and Jones have yet to respond to requests for comment.

Justin Bieber Summoned To Argentina Court For Questioning

BUENOS AIRES, Argentina (AP) — An investigative judge in Argentina is summoning Justin Bieber for questioning.

Bieber has been accused of sending bodyguards to attack a photographer outside a Buenos Aires nightclub during a South American tour last year. Judge Facundo Cubas asked Interpol on Thursday to use all “necessary means” to notify the singer that he has 60 days to appear before the court in Argentina. The judge says that if Bieber fails to comply, an international arrest order will be issued.

Argentine photographer Diego Pesoa alleges he was chased down and beaten on Nov. 9, 2013, by Bieber’s bodyguards outside the INK nightclub, where the singer and his entourage partied.

Bieber would face up to one year in prison if he was convicted on a charge of causing minor injuries.

Woman Who Says She Bought Renoir At Flea Market For $7 Challenged In Court

The question of who owns a tiny Renoir landscape of the River Seine may rest on a four-page handwritten letter penned 78 years ago by a middle-aged woman in a bad mood.

The letter, by the Baltimore art collector Saidie A. May, is reprinted verbatim as part of a 154-page motion for summary judgment filed late Tuesday in U.S. District Court in Eastern Virginia by attorney Marla Diaz on behalf of the Baltimore Museum of Art.

In effect, the motion asks federal Judge Leonie M. Brinkema to determine that the 1879 oil painting “Paysage Bords de Seine” belongs to the Baltimore museum and not to the 51-year-old Virginia woman who says she bought it at a flea market in 2009 for $ 7 as part of a box of odds and ends.

The letter by the then-56-year-old May is dated Oct. 14, 1935. It’s key to the case because it indicates that the heiress owns the tiny painting (framed, it is about the size of a piece of notebook paper) and planned to lend it to her hometown museum. May later bequeathed her art collection — including the Renoir painting — to the Baltimore museum, according to the motion.

May’s missive, replete with underlinings and multiple exclamation points, was written to Roland McKinney, who at the time was the museum’s director. The heiress — one of the art institution’s major benefactors — seems primarily interested in scolding McKinney about the sorry condition of a religious painting in the museum’s possession. (“It was never in such a bad shape and I’m sick about it,” she writes.)

It isn’t until the very bottom of the third page that May gets to the matter that has attracted interest throughout the art world for the past 15 months:

“The Modern Art Museum will be sending you very soon some small paintings of mine which I am willing to loan the Museum indefinitely if you insure them!!”

The second painting she lists as “Au Bord de la Seine” by Renoir next to this price: $ 1,010.

The peacefulness of the Seine scene, depicted on a linen napkin, belies its tumultuous recent history.

The artwork by the French Impressionist master surfaced publicly in September 2012 when Marcia Fuqua, 51, of Lovettsville, Va., who is also known as Martha, said that she bought the artwork from the Harpers Ferry Flea Market in 2009 without being aware that it was an original Renoir.

She said it was her mother, who went by the names Marcia Mae Fuqua and Marcia Fouquet and who had a fine-art background, who urged her to have the painting appraised. Fouqet died Sept. 9 of this year.

The painting was authenticated by The Potomack Company, a Virginia auction house, which estimated the artwork’s value at between $ 75,000 and $ 100,000. An auction was scheduled for two weeks later, and the inquiries began pouring in from potential buyers internationally.

But the day before the painting was to be sold, the Baltimore Museum of Art produced documents indicating that the work had been stolen from what was then known as the Polk Gallery after the museum closed at 6 p.m. Nov. 16, 1951, and before 1 p.m. the following day.

The auction was called off. The FBI seized the painting and has been holding it in secure storage in Manassas, Va., until Judge Brinkema can resolve the ownership question.

For a time, it appeared that the painting’s rightful owner might have been the Fireman’s Fund Insurance Co., which paid the BMA’s $ 2,500 theft claim. However, last month, the insurance company transferred its rights to the artwork to the museum.

Diaz’s motion doesn’t dispute Fuqua’s account of how she came to acquire the oil painting. Or, if any doubt is expressed, it is delicately worded.

“Notwithstanding the ‘Renoir’ plate on the frame of the painting and the paper on the back indicating that it was by Renoir and entitled ‘Paysage Bords de Seine,’ Fuqua did not realize that the painting was an original Renoir at the time of her purchase or in the following years,” the motion reads.

“Even if she did purchase the painting at a flea market without knowledge of its authorship and/or title, her claim must still fail as a matter of law because the painting was stolen from the BMA.”

In Diaz’s motion, she provides documents indicating that the Renoir landscape was exhibited at the Baltimore museum at least twice: in March 1950 as part of an exhibit of the May Collection, and again in November 1951, when it was included in a show titled “From Ingres to Gauguin.”

It was during that show that the painting disappeared.

To bolster her argument, Diaz cites the example of a Tiffany sword dating back to the Civil War that vanished from Brown University sometime between 1974 and 1977. The sword was purchased in 1992 from an Illinois antiques dealer by a couple named Donald and Toni Tharpe.

After Brown discovered the whereabouts of the missing weapon, university officials sued to have the sword returned. The lawsuit was filed in the Eastern District of Virginia — the same district where the Renoir case is pending. Though the Tharpes argued that they had purchased the artifact in good faith, earlier this summer, Magistrate Judge Douglas Miller ruled that the sword belongs to the university and ordered it returned.

In her motion, Diaz argues that the case for the museum’s ownership of the Renoir is even stronger than the winning case presented by Brown University.

Unlike the theft of the sword, which was never fully documented, the Renoir painting was reported to have been stolen within hours after the theft was discovered. Diaz’s motion includes four separate documents alluding to the theft.

She argues that under “well-settled Virginia law” good-faith purchasers of stolen goods are out of luck.

“Ms. Fuqua could not have purchased good title to the painting and does not, therefore, have a valid claim to possession and ownership of the painting,” Diaz’s motion argues. “Her claim to possession and ownership of the painting must be dismissed.”

Fuqua’s attorney, T. Wayne Biggs, declined to comment Tuesday, though he is expected to file a formal response to the motion for summary judgment this month.

A motion for a summary judgment can be granted only if the germane facts in the case aren’t in dispute, if they are so clear-cut that a jury could reach just one possible verdict under the law.

That’s a steep bar for any attorney to surmount — and Fuqua’s attorney has yet to make his client’s case.

But, at a pretrial conference last week, Judge Brinkema might have given a hint as to her thinking. She told the attorneys: “This is a relatively straightforward, simple case. It shouldn’t take much time.”

She will hear oral arguments in the motion on Jan. 10.
